Bull City Boudoir operates as a DBA of Dos Avocados LLC.

For your peace of mind, Bull City Boudoir is fully insured, both in studio and on location.

Our services are exclusively for consenting adults over the age of 18. Proof of legal age is required for all clients and session participants. Any persons unable or unwilling to provide proof of legal age will not be allowed to participate.

Limit of Liability

Bull City Boudoir is not responsible or liable for any risks associated with on-location photo sessions, client activities, or actions. We are not responsible for injuries, damage to property, or risks inherent to the location or setting in the course of a creative session.

While we will make every reasonable effort to record the images specifically requested by our clients, creative sessions are uncontrolled events, and due to the vagaries of weather, available light, time restrictions, and the willingness of subjects, Bull City Boudoir cannot guarantee that ALL requested photos will be taken. Any lists supplied will be used for organizational and advisory purposes only.

If the health, safety, well-being, or life of the photographer or the photographer’s equipment is in jeopardy, both perceived or real, the photographer may end the session and leave the premises with all equipment. In such a situation, Bull City Boudoir will not be held liable for any missed coverage or a reduction in the final number of images provided, nor will a refund be provided.

In the unlikely event that your photographer is injured or becomes too ill to attend the photo session, we will make every effort to reschedule to the earliest possible date. If the situation should occur, and the photo session must take place on the scheduled date, Bull City Boudoir will make every effort to secure a replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received.

Ensuring the appropriate behavior of all guests and other persons at the session and other events covered by Bull City Boudoir is solely the responsibility of the client. In the event the photographer or any of their associates experience any inappropriate, threatening, hostile or offensive behavior (including, but not limited to, unwelcome sexual advances and verbal or physical conduct of a sexual nature), we reserve the right to end the session immediately without the possibility of a refund.

We take the utmost care to protect your privacy and the security of your data and images, however, Bull City Boudoir is not responsible for security breaches involving third-party service providers or that result from the actions of our clients.

Scheduling and Cancellation

Upon booking your session, Bull City Boudoir will reserve the time agreed upon and will not make another reservation for the specific time frame. For this reason, all session fees are non-refundable even if the date is changed or if the photo session becomes canceled for any reason. The session fee is transferable to another date in the event you wish to amend your booking with at least 48 hours’ notice. Special consideration is made for maternity sessions. The session fee does not include any images, either prints or digital negatives; these must be purchased separately.

In the case of camera failure, inclement weather, or any other unforeseen incident that prevents Bull City Boudoir from photographing on a scheduled date, a new date will be scheduled, or the client will be refunded their session fees, if applicable. 

However, we realize that exceptional circumstances can take place. Therefore, we do honor requests for a refund for the reasons outlined in the limits of liability section.

Payments

All prints and products are subject to your state sales tax and shipping when applicable. Due to the nature of custom photography, all sales are final. Bull City Boudoir does, of course, guarantee that the portraits you receive meet the highest standards in every respect and works with our customers to approve designs and custom work before orders are placed. 

Payment of orders is due in full when the order is placed, unless an alternative payment plan is agreed to prior to purchase. Prints and products arrive 4-6 weeks after payment is received.  Rush shipment is available on some items for an additional charge. All rates are subject to change at any time. In the interest of fairness to all customers, all rates are non-negotiable unless booked through a special promotion.

Refunds

Since Bull City Boudoir provides non-tangible, irrevocable goods and services, we do not issue refunds once a session or event is booked. If you need to reschedule your photo session, please let us know as soon as possible, so that we can see if you can apply your session fee to a different day or time. You may risk losing your booking fee if your date has been in high demand or if you do not reschedule.

Refund Policy for Portrait Sessions and Prints

Bull City Boudoir is not responsible if the client and/or key individuals fail to appear or cooperate during photo sessions, or for missed images due to details not revealed to the photographer. If the client and/or key individuals fail to appear at a scheduled photo session, the session fees are non-refundable and will not be applied towards future sessions. The session can be rescheduled at the cost of an additional photo session fee.

Due to the nature of digital photography and the fact that photographs, once sent, cannot be returned, Bull City Boudoir has a strict no-refunds policy. Once a transaction has been completed (i.e., the client selected and paid for the photo and then Bull City Boudoir sent the client the correct photograph), it is then considered non-refundable. If a client has selected and purchased an incorrect photo, the client must notify Bull City Boudoir before receiving the “incorrect” photograph. 

Refunds will NOT be given due to “not liking a photo”, selecting an incorrect photo after the client has already received the photograph, or any other reason. If a mistaken photo is sent to the client, as documented on the invoice, Bull City Boudoir will send the correct photo to the client free of charge.

Refund/Exchange Policy for Custom Photo Books and Products

Due to the custom pre-designed nature of these services, there are no refunds on any design order. Albums ordered are considered a custom product, and therefore there are no refunds on any album orders. Custom puzzles, Lay Flat Albums, and Coffee Table Books are made to order and cannot be returned or exchanged unless:

  • a manufacturer defect is evident and reported within 48 hours (2 business days) from the date it was received,
  • damaged during shipping (a separate claim must be filed with the shipping carrier and also must be reported within 48 hours after being received),
  • or in the event that the order was erroneously processed, such as an error was made on the size of the book or color/style, compared to the original recorded order.
